THE MCMINN COUNTY SHERIFF'S DEPARTMENT
DRUG ENFORCEMENT DIVISION
Enforces the controlled substance laws of the State of Tennessee through cooperation, education and the exchange of information between federal, state and local agencies. Most problems associated with drug abuse are the result of legitimately manufactured controlled substances being diverted from their lawful purpose into illicit drugs. By attacking and dismantling drug trafficking within the county, crime rates in other areas will decrease as well. Seizure and forfeiture of assets intended to be used for illicit drug trafficking are auctioned after conviction. The monies received from these assets are put into the drug fund to support the department and purchase equipment used in combating the war on drugs.
These are the Tennessee Codes Annotated statutes and sections that allows for these seizures, forfeitures and conveyances to happen:
- Narcotics and Drug Related Offenses ( TCA 53-11-201 et seq., 40-33-201 et seq.)
- DUI-Second or Subsequent VIolations (TCA 55-10-401 et seq., 40-33-201 et seq.)
- Driving on Revoked due to DUI (TCA 55-50-504 et seq, 40-33-201 et seq.)
- Alteration of Vehicle's Identification Numbers (TCA 55-5-108 et seq.)
- Other (in which the seizing officer must show documentation by state statute that allows for the seizure to occur.)
